Apex Solutions Company Policies
Use and Misuse of the Services
All complaints of abuse, violation and misuse of the
Services, whether described in this section or otherwise,
shall be investigated promptly. If you are not sure
if your actions will be an abuse, violation or misuse,
then please contact abuse @ apexsol.com.
You are responsible for all use of your website, with
or without your knowledge or consent.
You agree to use the Services only for lawful purposes,
in compliance with all applicable laws. Illegality includes,
but is not limited to: Drug dealing; Attempting without
authorization to access a computer system; Pirating
(distributing copyrighted material in violation of copyright
law, specifically MP3s, MPEGs, ROMs, and ROM emulators);
Gambling; Schemes to defraud; Trafficking in obscene
material; Sending a message or having content that is
obscene, lewd, lascivious, filthy, or indecent with
intent to annoy, abuse, threaten, or harass another
person; Threatening bodily harm or damage to individuals
or groups; Violating U.S. export restrictions; stalking;
or violating other state or federal law, such as the
Electronic Communications Privacy Act, the Computer
Fraud and Abuse Act, or the Economic Espionage Act.
Linking to illegal material is also prohibited.
When apexsol.com becomes aware of possible
violations of this Agreement, apexsol.com may initiate
an investigation that may include gathering information
from you and the complaining party, if any, and examination
of material on apexsol.com's servers. apexsol.com, in
its sole discretion, will determine what action will
be taken in response to a violation on a case-by-case
basis. Violations of this Agreement could subject you
to criminal or civil liability.
BY ACCEPTING THIS AGREEMENT, YOU AGREE
TO WAIVE AND HOLD APEXSOL.COM HARMLESS FROM ANY CLAIMS
RELATING TO ANY ACTION TAKEN BY APEXSOL.COM AS PART
OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THIS
AGREEMENT OR AS A RESULT OF ITS CONCLUSION THAT A VIOLATION
OF THIS AGREEMENT HAS OCCURRED. THIS MEANS THAT YOU
CANNOT SUE OR RECOVER ANY DAMAGES WHATSOEVER FROM APEXSOL.COM
AS A RESULT OF APEXSOL.COM DECISION TO: REMOVE MATERIAL
FROM ITS SERVERS, WARN YOU, SUSPEND OR TERMINATE YOUR
ACCOUNT, OR TAKE ANY OTHER ACTION DURING THE INVESTIGATION
OF A SUSPECTED VIOLATION OR AS A RESULT OF APEXSOL.COM
CONCLUSION THAT A VIOLATION HAS OCCURRED. THIS WAIVER
APPLIES TO ALL VIOLATIONS DESCRIBED IN THIS AGREEMENT.
Use and Misuse of Materials
Materials in the public domain (e.g., images, text,
and programs) may be downloaded or uploaded using the
Services. You may also re-distribute materials in the
public domain. You assume all risks regarding the determination
of whether the material is in the public domain.
You are prohibited from storing, distributing
or transmitting any unlawful material through the Services.
Examples of unlawful material include, but are not limited
to, threats of physical harm, child pornography, and
copyrighted, trademarked and other proprietary material
used without proper authorization. Pornography and sex-related
merchandising, or links to such material, even if legal,
are not acceptable uses of apexsol.com's servers. You
may not post, upload or otherwise distribute copyrighted
material on apexsol.com's servers without the consent
of the copyright holder.
Unacceptable uses of website content
also include the presence of the following programs
or the activities associated with them, regardless of
whether or not any actual intrusion results in the corruption
or loss of data: Server broadcast messages or any message
sent on an intrusive basis to any directly or indirectly
attached network; Attempts to circumvent any user authentication
or security of host, network, or account; Accessing
data not intended for user; probing the security of
any network; Spawning dozens of processes; Port scans,
ping floods, packet spoofing, and forging router information;
Denial of service attacks, sniffers, flooding, spoofing,
ping bombing, smurfs, winnuke, land and teardrop; Promulgation
of viruses; and IRC bots, such as eggdrop or BitchX.
Apexsol.com supports free speech on
the Internet and will not suspend or cancel your account
simply because it disagrees with your views expressed
at your website. However, examples of unacceptable activities
include posting private information about a person without
his or her consent, defaming a person or business, and
knowingly making available code that will have a deleterious
effect on third-party computers. Where there are allegations
that your on-line activity has violated the legal rights
of a third party, apexsol.com will not substitute itself
for a court of law in deciding tort claims raised by
the third party.
Email Use
Unacceptable affronts to netiquette and unacceptable
activities include, but are not limited to, the following:
Spamming (sending unsolicited advertising to those with
which you have no existing business relationship and
posting off-topic advertising in newsgroups); Spoofing
(using a return email address that is not the valid
reply address of the sender or sending an email message
that does not contain enough information to enable the
recipient to identify you); Passive spamming (promoting
a website hosted by apexsol.com by spamming from some
other source); trolling (posting controversial messages
in newsgroups to generate responses); Mailbombing (inundating
a user with email without any serious intent to correspond
or sending large or multiple files to a user); Generating
a higher volume of outgoing mail than a normal user
(over 10% of available system resources); Propagating
chain letters; and subscribing someone else to an electronic
mailing list without that person's permission. A message
is considered unsolicited if it is posted in violation
of a newsgroup charter or sent to a recipient who has
not requested the message. Making an email address available
to the public does not constitute a request to receive
messages. Distribution of mass emailing programs is
also prohibited. All recipients on a mailing list must
have personally subscribed. Mailing lists may not be
used to distribute unsolicited email. If you are repeatedly
mailbombed or attract such behavior, the Services will
be terminated.
You should not send email to any user
who does not wish to receive it, either at apexsol.com
or elsewhere. apexsol.com recognizes that email is an
informal medium; however, you must refrain from sending
further email to a user after receiving a request to
stop.
You may not alter the headers of email
messages to disguise their identity or to prevent users
from responding to the messages. apexsol.com may disclose
the usernames of accounts responsible for forged email
messages to system administrators or users requesting
the information.
Violations of the apexsol.com policies
outlined herein can sometimes result in massive numbers
of email responses. If you receive so much email that
apexsol.com resources are affected, apexsol.com's staff
may shut down your mailbox.
System Security
You are prohibited from utilizing the Services to compromise
the security of system resources or accounts on servers
at apexsol.com or at any other site. Use or distribution
of tools designed for compromising security or containing
viruses or trojans is prohibited. Examples of these
tools include, but are not limited to, password guessing
programs, cracking tools or network probing tools.
If you are involved in violations of
system security, apexsol.com reserves the right to release
all usernames of users involved in such violations to
system administrators at other sites in order to assist
them in resolving security incidents. apexsol.com will
also fully cooperate with law enforcement authorities
in investigating suspected lawbreakers.
System Resources
System abuse includes any use of apexsol.com's resources
that disrupts the normal use of its servers or services
for others. Examples of system abuse include running
excessive numbers of processes or consuming excessive
amounts of CPU time, memory or disk space.
Any usage of 10% or more of apexsol.com's
system resources is an undue burden on apexsol.com's
system and is unacceptable. If your usage ever exceeds
10% of system resources, your account may be terminated
immediately and without prior notice.
Further, running programs in the background
on a Apex Solutions server without apexsol.com's prior
written authorization, or running chat rooms, Internet
Relay Chat, IRC bots, mailing lists that send more then
1,000 emails a day and the like are not acceptable uses
of apexsol.com's servers.
Privacy Policy
Apex Solutions (“Apex Solutions”) respects the privacy of
its customers and visitors and is committed to protecting the personal
information of its customers and visitors. This Privacy Policy covers the site
http://www.ApexSol.com. We collect no personally identifiable information about
you when you visit our site unless you choose to provide that information to us
or as specifically outlined in this Policy. This Policy is incorporated into
and subject to the Terms of Use (“TOU”) Agreement.
This Policy describes our general principles for the
collection and use of information from customers and visitors to our websites.
We want to ensure that you understand how we will and will not use the
information you entrust to us. In order to fully understand your rights we
encourage you to read this Policy.
For visitors, we've structured our websites so that, in
general, you can visit us on Web without identifying yourself or revealing any
personal information.
For prospective and existing customers and partners, once
you choose to provide us personally identifiable information (any information
by which you can be identified), you can be assured that it will only be used
to support your relationship with Apex Solutions.
What type of information does Apex Solutions collect?
When you visit our website, our Web server collects basic

accessed our website, and the pages from within our website that you visit and
is not personally identifiable information except as needed to prevent fraud or
abuse of the system.
When you sign up for Apex Solutions's services, you provide
us with both contact and payment information. Contact information typically
includes your name, address, and phone number. Payment information typically
includes your credit card number.
While you are a Apex Solutions customer, we manage
information with regard to your account status, choice of services, and
customer logs. In addition, we may store customers' electronic mail and other
communications as a necessary incident to the transmission and delivery of
those communications.
Surveys or Contests
From time-to-time, we may provide you the opportunity to
participate in contests or surveys on our site. If you participate, we will
request certain personally identifiable information from you. Participation in
these surveys or contests is completely voluntary and you therefore have a
choice whether or not to disclose this information. The requested information
typically includes contact information (such as name and shipping address), and
demographic information (such as zip code).
We use this information to notify contest winners and award
prizes, to monitor site traffic or personalize the site (in the case of
anonymous information collected in surveys), to send participants an email
newsletter.

surveys or contests; that company will be prohibited from using our users’

How do we use this information?

handling some of the information we receive, such as order fulfillment for
phone services. Those affiliates are not authorized to use such information for
purposes beyond those specified by us including marketing and are required to
preserve the confidentiality with which we treat such information. We may
disclose contact information with your permission when gathering and posting
testimonials.
We will not otherwise disclose customer personal and account
information unless we have reason to believe that disclosing such information
is necessary to identify, make contact with, or bring legal action against
someone who may be causing harm or interfering with the rights or property of
Apex Solutions, our customers, or others. We may provide information to
regulatory authorities and law enforcement officials in accordance with
applicable laws, respond to legal process, or where Apex Solutions has a good
faith belief that the law requires such disclosure.
Apex Solutions also will not disclose to third parties the
contents of any electronic mail or other electronic communications that Apex
Solutions stores or transmits for its customers except where: (a) it is a
matter or public safety or policy; (b) it is in connection with the transfer of
other business assets; (c) it is required to cooperate with orders, warrants,
or other legal process that Apex Solutions determines in its sole discretion to
be valid and enforceable; and (d) it is necessary to provide to a law enforcement
agency when the contents are inadvertently obtained by Apex Solutions and
appear to pertain to the commission of a crime.
Apex Solutions disclaims any intention to censor, edit, or
engage in ongoing review or surveillance of communications stored on or
transmitted through its facilities by customers or others. Apex Solutions will,
however, review, delete, or block access to communications that may harm Apex
Solutions, its customers or third parties. The grounds on which Apex Solutions
may take such action include, but are not limited to, actual or potential
violations of the TOU.
Please note that Apex Solutions may use this information
collected to direct service notices as well as provide you with other general
information that may be of interest to you and information about our services
or product offerings that you have opted to receive, as well as other important
information regarding your account or services at our discretion.
Customers may opt out of receiving newsletters and/or
promotional emails from Apex Solutions by sending a request to
newsletter-unsubscribe@ApexSol.com, by using the unsubscribe instructions
included in each promotional communication, or by changing your email
preferences on the site within your Account information. In this request,
customers must identify their domain name and contact information. Customers
may not opt out of receiving information from Apex Solutions which is essential
for maintaining or updating customers account or system information.
Third Party Advertising and Cookies
The basic user information collected is used to help us
analyze Web traffic, improve the content of our website and improve your
experience on our website.
We do not trade, rent or sell your personal information to
others, except as detailed in this Policy. We currently contract with several
online partners who use the data only on our behalf to help manage and optimize
our Internet business and communications. We use the services of a marketing
company to help us measure the effectiveness of our advertising and how
visitors use our site. To do this, we use Action Tags and cookies provided by
our marketing company on this site. The information collected by the marketing
company through the use of Action Tags and cookies is not personally
identifiable. We have no access or control over these third party cookies or
